We Aim to Combat Dominance and Economic Concentration

The Ministry of Economy controls, monitors and regulates commercial practices and prevents practices that may prejudice, restrict, or prevent competition, in order to promote business environment and investment climate in the UAE markets. To this end, the Ministry follows up on commercial practices in markets and responds efficiently and effectively to any requests submitted regarding the possibilities of domination. The ministry also monitors economic concentration of various economic activities within the UAE according to the procedures for implementing Federal Law No (36) of 2023 on the Regulation of Competition.

The Process of Economic Concentration Requests

Businesses operating in the UAE shall submit applications for economic concentration to the Competition and Consumer Protection Department of the Ministry of Economy. The department examines the application in a formal and objective manner to ensure that the acquisition or merger will not lead to the dominance or control of an organisation within the UAE markets at rates exceeding the percentages specified in the relevant decisions and laws. The Ministry is keen to involve all competent entities to investigate the best procedures to deal with the submitted requests in a way that benefits all parties. The Ministry of Economy received three applications for economic concentration in 2020.

The Ministry of Economy Takes Decisions Regarding Applications for Economic Concentration

The Ministry of Economy investigates the request for economic concentration and verifies the supporting information and documents to take the appropriate decision in accordance with the provisions of Federal Law No. 4 of 2012 on the Regulation of Competition, as follows:

Approve the economic concentration process if it has no adverse impact on competition, or if it has positive effects that exceed the negative effects on competition.

Approve the economic concentration process, provided that the relevant organisations undertake to comply with the conditions and obligations established by a decision by the ministry.

Reject the economic concentration process.
